The Connections Academy “Virtual Schools Click With Me!” Video Contest is open to all students, their families and Connections Academy employees!
Contest Rules
Your participation in the Contest, including your submission of a Video to Memelabs.com shall be deemed to be your complete acceptance of the terms and conditions set out below by Memelabs.com (hereinafter referred to as Organizer) and Connections Academy, LLC (hereinafter referred to as Sponsor).
CHILDREN AND MINORS: Consistent with the Federal Children's Online Privacy Protection Act of 1998 (COPPA), we will never knowingly request personally identifiable information from anyone under the age of 13 without requesting parental consent. Additional information can be found on the U.S. Federal Trade Commission website. Any entrant who is a minor in his/her jurisdiction of legal residence will be required to obtain the permission of his/her parent or legal guardian to participate in this Contest. Entrant must also have obtained all necessary permissions from anyone else featured in his/her Submission, including permission from parents or legal guardians of minors included in such Submission (written proof of such permission must be made available to Sponsor upon request).
PARTICIPATION CONSTITUTES ACCEPTANCE OF RULES AND DECISIONS, CONSENT TO USE AND RELEASE OF CLAIMS. By entering this contest, each participant warrants that he or she has read and agrees to abide by all contest rules and that he or she is not prohibited from participating in the contest. Participation in this contest constitutes participant’s full and unconditional acceptance of these Official Rules and the decisions of Sponsor, its parents, affiliates, employees and agents, which are final, binding and non-negotiable in all respect. Each participant agrees to release, discharge, indemnify and hold harmless Sponsor and its parents, affiliates, shareholders, employees, officers, directors, agents, representatives, advertising and promotion agencies and prize suppliers from any liability arising from or related to the Contest, including without limitation: (a) unauthorized human intervention in the Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (d) personal injury, death, and property damage; and (e) claims based on publicity rights, defamation, or invasion of privacy. Further, participants fully and unconditionally release all claims for consideration, trademark, trade secret, patent or copyright infringement, and all other claims of any nature relating to the use of their entry, name or likeness.
ELIGIBILITY: The Contest is open to students currently enrolled in program offered by the Sponsor, their parents/guardians (“Caretakers”), Learning Coaches and employees of Sponsor. Entrants must be enrolled or otherwise have access to the Sponsor’s Learning Management System in order to be able to participate, Caretakers must give permission for minors to participate in the Contest and to upload any videos. Your participation in the Contest, including your submission of a Video to Memelabs.com shall be deemed to be your complete acceptance of the terms and conditions set out below by Organizer and Sponsor.
1. All entries must be received by September 14th, 2009, 11:59 PM, ET. An entrant may enter as many times as he or she would like! Just remember to keep it simple and keep it fun!
2. Videos can be shot with camera phones, digital Video cameras or any other digital moving image format. No video tape entries will be accepted.
3. There is no cost or purchase required to enter this Contest. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS APPLY.
4. Entry to the Contest is only open to persons currently enrolled in a course or program offered by Sponsor, their Caretakers, Learning Coaches, and employees of Connections Academy.
5. By submitting your contribution to the Organizer in relation to the Contest you agree to assign to Sponsor, without further consideration, all right, title, and interest (throughout the United States and in all foreign countries), free and clear of all liens and encumbrances, in and to the Videos, which shall be the sole property of the Company. If any moral rights are created, you hereby waive such rights in the Videos. You agree to execute all documents necessary or proper to obtain letters patent, copyright or other applicable registrations thereon and to vest the Company with full title thereto. Should the Company be unable to secure your signature on any document necessary to apply for, prosecute, obtain, or enforce any patent, copyright, or other right or protection relating to any Videos, whether due to your mental or physical incapacity, or unavailability, or any other cause, you hereby irrevocably designate and appoint the Sponsor and each of its duly authorized officers and agents as my agent and attorney-in-fact, to act for and in my behalf and stead, to execute and file any such document, and to do all other lawfully permitted acts to further the prosecution, issuance, and enforcement of patents, copyrights, or other rights or protections with the same force and effect as if executed and delivered by you.
6. By submitting your contribution to the Organizer in relation to the Contest you represent, warrant and undertake to Sponsor and Organizer that your contribution (i) is in its entirety your own original work and that you have the sole right to submit it to the Contest (ii) does not violate in any way rights of third parties including copyright and other intellectual property rights and (iii) does not violate any applicable laws.
7. In the event that you breach any of your representations, warranties or undertakings contained herein Sponsor and Organizer shall be entitled to and may seek indemnification from you for recovery of all legal
fees, damages, claims and other expenses that may be incurred by Sponsor or its affiliated entities as a result of your aforementioned breach.
8. Your contribution to the Contest should not include any content whatsoever which would reasonably be understood to be defamatory, threatening, distasteful, racist, unlawful or otherwise objectionable.
9. Sponsor and Organizer reserve the right to alter or modify your contribution to the Contest without notification or consent from you.
10. Sponsor and Organizer reserve the right to change these terms and conditions at any time and at its sole discretion.
11. Entrants agree to grant to Sponsor and Organizer (only where acting as agent of Sponsor) an everlasting, royalty-free, assignable, exclusive license to use, utilize, replicate, alter, adapt, modify, publish, broadcast, translate, produce derivative works from, distribute, present, play, sublicense and exercise all copyright and other intellectual property rights with respect to your contribution worldwide and/or to include your contribution in other works in any media now known or later created forever. Each entrant agrees and grants Sponsor and Organizer (only where acting as agent of Sponsor) permission to make available and display/perform and otherwise distribute entrant's name and Video submission in all media in perpetuity without compensation. Except where legally prohibited, submission of an entry into this Contest constitutes permission for Sponsor and Organizer(only where acting as agent of Sponsor) to use the entrant's name, videograph, likeness, voice, address (city and province/state) and testimonials, in printed, broadcast media or new media, in perpetuity, in any manner they deem appropriate in connection with promoting the Video submission itself or this Contest, without further compensation in connection with this Contest or the prize awarded.
12. Each entrant agrees to indemnify Sponsor from any third party claims arising from or related to that entrant's participation in the Contest. By participating, entrants agree that Sponsor, Organizer involved in the development, production, implementation and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Contest, including entry and participation in this Contest and acceptance, possession, use or misuse of the prizes. All entrants further agree that in the event of any third party claims, damages, losses or injuries, arising from or relating to this Contest, they will indemnify Organizer and Sponsor from any and all such claims, including the attorneys' fees related thereto. Organizer and Sponsor shall not be responsible for any technical malfunctions of the telephone network, computer on- line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury.
13. Entrants participating in this Contest are liable for any trademark, trade secret, and copyright infringements caused by their Videos. Entrants agree to ensure that they are correctly using and have obtained permission in using any Trademarks or Copyrighted content, or any other intellectual property of Sponsor or any of third parties.
14. Entrant is responsible to secure permission from all talent included in the Video. Sponsor and Organizer assume no responsibility for royalties or fees associated with talent performances in the entered Videos.
15. Sponsor and Organizer assume no responsibility for lost or late entries or for incomplete computer transmissions or technical failures.
16. Sponsor and Organizer reserve the right not to accept entries that are considered inappropriate for the Contest.
Video Creation Requirements
Acceptable source Video includes sources that are not copyrighted. Entrant agrees to take responsibility to ensure that all images, content and soundtracks incorporated into the Videos are not copyrighted material. This means, do NOT use commercial copyrighted music or images. Videos may not contain obscene language or content, including but not limited to: nudity, profanity, or graphic violence. Videos must be submitted via the web as instructed after registration. If you have problems uploading, please contact info@memelabs.com. If you are having problems uploading, you must contact info@memelabs.com before the Contest has expired.
Prizes
First Place winners receive a certificate and Flip Video Ultra Camcorder, 60 min. - 2GB (Orange if available)
First Place Prizes will be awarded for each of the following categories:
- Learning Coach/Caretaker (decided by highest number of public votes)
- Student in Kindergarten - 5th grade(decided by highest number of public votes)
- Student in 6th - 8th grade (decided by highest number of public votes)
- Student in 9th - 12th grade (decided by highest number of public votes)
- Employee/Teacher (decided by highest number of public votes)
- Principals Pick (decided by committee based on message/production quality/creativity)
Second Place winners receive a certificate and $25 Amazon.com gift certificate.
Second Place prizes will be awarded in every school!
- One second place prize winner will be selected from all enrolled students in each school.
Notification
Prizes will be delivered shortly after the winning Videos are announced.
Sponsor will notify the winner by first class mail, email, webmail and/or telephone, at its discretion, on or around September 29th, 2009 at the contact information provided on the entry form. Sponsor is not responsible for lost, stolen, late, or misdirected mail. If unable to make contact with the winner within ten (10) days after Sponsor’s first attempts to notify the winner, or if the winner fails to claim the prize in accordance with these Official Rules, Sponsor will award the prize to the alternate winner. The winner must claim the prize by signing and returning the Authorization and Release form provided by Sponsor, a copy of these contest rules, and a completed W-9 form no later than October 11th, 2009. In addition, the winner will cooperate with Sponsor to get all necessary releases and assignments of ownership in place for the Videos submitted to Sponsor. The winners and title of their entry will be announced on the Sponsor website and on the Contest website.
Showcasing Of Videos
Winning Videos and other Videos may be showcased at www.ConnectionsAcademy.com and in any other forum or media at the discretion of the Sponsor. The contributor may be identifiable through credit given for the work, or by the work itself. The Contest format permits broad distribution of the submitted Videos, and Videos could be sent to and displayed on other sites such as YouTube.com, etc. If you do not agree with the broad distribution and showcasing of Videos, do not submit an entry to the competition.
